WAITITU’S KSH588 MILLION GRAFT CASE SET FOR FRESH COURT DIRECTIONS ON OCTOBER 27

Former Kiambu Governor Ferdinand Waititu’s KSh588 million corruption case will return to court on October 27, 2026, as the prosecution and defence await clarification on how proceedings involving money-laundering charges should proceed.

The matter was placed before the Deputy Registrar on Thursday, October 22, but no substantive directions were issued on the next steps in the case.

The court is expected to give further directions during the next mention, following a legal dispute over the implementation of a High Court ruling that overturned earlier acquittals on three money-laundering counts against Waititu, his wife Susan Wangari, and their co-accused.

On October 14, 2026, High Court Judge Rose Ougo upheld the convictions in the corruption case but set aside the acquittals on the money-laundering charges following an appeal by the State.

The case was subsequently referred back to the Anti-Corruption Magistrate’s Court for mitigation and sentencing proceedings on the additional charges.

However, the process hit a legal hurdle after the defence challenged the proposed sentencing, arguing that the accused had previously been acquitted of the money-laundering charges by the trial court.

The prosecution, led by Vincent Monda, opposed the defence’s position, maintaining that the High Court had allowed the State’s appeal and directed the accused to return to the magistrate’s court for mitigation.

The disagreement prompted the court to seek clarification on how the High Court ruling should be implemented before the matter could proceed.

HOW THE KSH588 MILLION CASE STARTED

The case centres on a road construction tender worth approximately KSh588.7 million awarded during the 2017/2018 financial year in Kiambu County.

The contract involved upgrading gravel roads to bitumen standards in several areas, including Thika, Limuru, Gatundu North, Juja and Ruiru.

Prosecutors linked the tender to alleged procurement irregularities and the handling of funds associated with the contract awarded to Testimony Enterprises Limited.

In February 2025, Waititu was sentenced to 12 years in prison or a fine of approximately KSh53.5 million following his conviction on corruption-related charges.

The High Court upheld the convictions in its October 2026 ruling and overturned the earlier acquittals on the three money-laundering counts.

The court also revoked the bail terms previously granted to the accused, paving the way for further proceedings arising from the additional convictions.

The October 27 court mention is expected to clarify the next course of action as the parties await further directions on the implementation of the High Court decision.
